Privacy Policy

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the “GDPR”) and Act No 101/2000, on the Protection of Personal Data, as amended.

The purpose of this document is to properly inform all providers of personal data, as data subjects, about the scope, purpose, duration and other aspects of the processing of their personal data in our company, and to inform them about their rights in relation to the processing of their personal data.

Who is the personal data controller?

Pursuant to Art. 4(7) of the GDPR, this is ASSIST spol. s r. o. (company ID No: 45796262), registered office Glowackého 545, Prague 8, 181 00, entered in the Commercial Register maintained by the Municipal Court in Prague – section C, insert 11517.

Whose personal data do we process?

We process the personal data of our clients, including potential clients who have expressed an interest in our services. We also process the personal data of our suppliers and people interested in working for us. You will find information specific for each of these categories of data subjects below:

Clients

What data we process and why

If you are our customer, we will process your data for the purpose of concluding and performing contracts or processing your orders (providing training or other services, invoicing, complaints) based on the legal title of the performance of a contract. We obtain the personal data primarily directly from you (when you fill in a form, when you send an order) and also from public sources (e.g., the Commercial Register, ARES — especially to verify the accuracy of already processed personal data). We process the following personal data for these purposes:

  • name, surname, title
  • contact details (telephone, email, address)
  • company name, registered office, company ID No, tax ID No
  • position in the company
  • services provided and their price
  • our mutual communication
  • invoicing details (bank details, information about payments)

The provision of personal data for the purpose of performing a contract is a contractual requirement and without it we cannot enter into a contract (accept an order).

We can further use your data when sending you commercial communications, meaning so that we can inform you about events or services we provide and which we consider could be relevant to you. The legal title for this processing is our legitimate interest. We can also send commercial communications to potential customers who have given us their consent. The granting of this consent to the processing of personal data is completely voluntary and is not needed for any other performance from us.

You can refuse the processing of your personal data for the purpose of sending commercial communications at any time, while such a refusal will have no effect on any other part of our relationship. Simply click on the ‘unsubscribe’ link in the commercial communication itself, or send us an e-mail with your request to assist@assist.cz or to the different address from which you received the commercial communication from us.

How long we will process the personal data

We will process your personal data for as long as we provide the service(s) to you or perform a mutual contract, and thereafter for a period of time needed for us to meet our archiving obligations pursuant to valid legal regulations (the retention time of your personal data is determined primarily by the Civil Code, which regulates limitation periods, accounting regulations, tax regulations, etc.) and for the necessary period of time in case we will need to submit evidence in judicial or administrative proceedings.

For processing based on our legitimate interest, we will retain the data for the duration of the purpose of the processing, meaning until such time that you object to their processing. If you have given us your consent to the processing of your personal data for the purpose of sending commercial communications, we will process your personal data for the duration of your consent or until it is withdrawn.

Suppliers

What data we process and why

If you are our supplier, we will process your data for the purpose of taking the appropriate measures before entering into a contract, when entering into and performing a contract, and for processing our order, all based on the legal title of performing a contract. We process the following personal data for these purposes:

  • name, surname, title
  • contact details (telephone, email, address)
  • company name, registered office, company ID No, tax ID No
  • position in the company
  • products and services provided and their price
  • our mutual communication (especially emails, telephone calls, chats/video conferences)
  • invoicing details (bank details, information about payments)

The provision of personal data for the purpose of performing a contract is a contractual requirement and without it we cannot enter into a contract.

With selected suppliers of services, we will also process the above personal data based on our legitimate interest for the purpose of enabling us to arrange commercial cooperation in the future.

How long we will process the personal data

We will process your personal data for as long as you provide us with products or services or perform a mutual contract, and thereafter for a period of time needed for us to meet our archiving obligations pursuant to valid legal regulations (the retention time of your personal data is determined primarily by the Civil Code where it regulates limitation periods, accounting regulations, tax regulations, etc.) and for the necessary period of time in case we will need to submit evidence in judicial or administrative proceedings.

Job applicants

What data we process and why

If you are applying for a job with our company, we will need to process your personal data for the purposes of performing the selection procedure and finding a suitable candidate for the open position. The legal title for this processing is negotiations with the intention of entering into a contract. We obtain the personal data directly from you or from public sources (e.g., information you have placed on social networks and the internet). We can also obtain personal data from recruitment agencies or from the person who referred you.

A curriculum vitae includes information, the scope of which we cannot influence. It is therefore not possible to provide an accurate list of all the personal data we will receive. As a rule, however, these are usually the following personal data:

  • name, surname, title
  • contact details (telephone, email, address)
  • nationality and work-permit information (for foreign nationals)
  • education and other training
  • information about previous employment and work experience
  • appropriate knowledge, skills and personality traits relevant to the job
  • requirements of the job applicant, full-time/part-time position, form of cooperation, salary, etc.
  • information provided by referrers
  • our mutual communication (especially emails, telephone calls, chats/video conferences)
  • other information provided by the applicant in the curriculum vitae and during the selection procedure

If we receive your consent, we can retain your personal data after the selection procedure in question so that we can contact you with an offer of similar jobs that we open at a later date and that we think could be of interest to you. The granting of this consent to the processing of personal data is completely voluntary and is not needed for any other performance from us.

How long we will process the personal data

We will process and store personal data collected in connection with a selection procedure for the duration of the selection procedure and thereafter for one year in relation to our obligation to demonstrate non-discriminatory behaviour and a fair and transparent selection procedure.

If you give us your consent to the processing of your personal data after the selection procedure in question and it is not stated otherwise in the consent, the retention period for your personal data will be five years from the granting of the consent, or until it is withdrawn.

Website visitors

When visiting our website, you are not specifically tracked, and the only personal data we have available is what you provide us with when sending a specific form.

Who has access to the personal data?

Our authorised employees and other persons who work for us may process the personal data. Our contractual partners (so-called processors) may also process the personal data, e.g., external accountants and IT service providers (Salesforce, Google, Microsoft, Zoom, etc.) that we use to store and process data. We carefully select and verify our processors. These processors are authorised to handle the personal data only within the scope essential for the performance of their tasks and for the agreed period of time. In some cases, our processors might process personal data in states outside the European Economic Area, however this is always subject to meeting all legislative and security requirements and in accordance with standard contractual clauses we have entered into with them.

We will use your personal data only for our own needs and, with the exception of the processors, we will not transfer them to any other parties (so-called third parties), abroad, or to international organisations, unless we are obliged or authorised to perform such transfer based on a legal regulation, or for our legitimate interest (e.g., the tax office, health insurance companies, labour offices, social security authorities, bailiffs) or if you have given your consent to such a transfer.

What are your rights?

In connection with the processing of personal data, you have the right to request:

  • that we provide you, upon request, with information about what data about you we process, and other information about such processing, including a copy of the processed personal data (the right to access);
  • that we correct or supplement your personal data, upon request;
  • that we delete your personal data if:
    • we no longer need them for further processing;
    • you have withdrawn your consent to their processing;
    • you are entitled to object to their processing;
    • they have been processed unlawfully;
    • they must be deleted pursuant to legal regulations;
  • that we restrict the processing of your personal data (e.g., if you claim that they are processed unlawfully or inaccurately and we verify the truthfulness of such a claim, or until your objection to processing has been resolved);
  • that we provide you with your personal data that you provided us with based on your consent or for the performance of a contract and that we process automatically, and in a format that enables their transfer to another controller;
  • that, based on your withdrawal of consent, we stop processing your personal data for which you previously granted your consent.

You also have the right to object to the processing of your personal data that we process based on legitimate interest.

If you wish to exercise any of these rights at any time, you can send an e-mail to the address assist@assist.cz, a letter to the above contact address, or cancel your subscription by clicking on the link directly in the commercial communication itself.

We will also notify you in the event of a breach of security relating to your personal data if such breach represents a significant risk to your rights and obligations.

You also have the right to send complaints or suggestions relating to the processing of your personal data to the supervisory authority, the Office for Personal Data Protection:
